These Terms and Conditions ("Terms") govern your access and use of the AusKeep platform ("Platform", "we", "us", "our"). By using the Platform, you agree to be legally bound by these Terms.

1. Platform Role and Disclaimer

AusKeep is a digital marketplace that connects independent workers (with valid ABNs) and hirers (businesses or individuals) seeking services. AusKeep:

Does not employ workers;
Does not act as a labour hire provider, recruitment agency, or contracting company;
Is not a party to any agreement formed between users;
Does not guarantee outcomes, performance, or legality of any service provided by users.

You acknowledge and agree that AusKeep's role is strictly limited to introducing parties and facilitating payments through the platform.

2. Eligibility

To use AusKeep, you must:

Be at least 18 years old;
Provide accurate, truthful, and complete registration details;
If registering as a worker, hold a valid Australian Business Number (ABN);
Comply with all applicable laws and regulations of Australia.

We reserve the right to verify ABNs and suspend accounts involved in fraudulent activity.

3. Payments and Commission

All payments must be made through the AusKeep platform.
AusKeep retains a pre-agreed commission on all completed transactions.
Users must not bypass the platform or its payment system to avoid fees.

4. User Conduct

You agree not to:

Use false or misleading information;
Engage in harassment, discrimination, or abuse;
Post or respond to jobs with illegal, unsafe, or exploitative expectations;
Solicit or accept off-platform arrangements.

5. Review System

Reviews must be honest and based on real interactions.
Fake or incentivised reviews are strictly prohibited.

6. Limitation of Liability

To the fullest extent permitted by law:

AusKeep is not responsible for job performance, payment defaults, or any harm arising from user interactions;
AusKeep makes no guarantees regarding job availability, success, or financial outcomes.

7. Termination

We may suspend or terminate your account without notice if:

You breach these Terms;
You are reported for unsafe, abusive, or fraudulent behaviour;
You attempt to bypass the platform or commit any unlawful activity.

8. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes must be resolved in the courts of Melbourne, VIC.

9. No Labour Hire Relationship

AusKeep is not a Labour Hire Provider under the Labour Hire Licensing Act 2018 (VIC) or equivalent legislation in other states. All users of the platform are independent entities and are solely responsible for their own legal, tax, and employment obligations.

10. Disclaimer of Warranties and Limitation of Liability

To the fullest extent permitted by law, AusKeep provides the platform "as is" and without any warranties, express or implied. We do not guarantee the accuracy, reliability, or availability of the platform or any user-generated content. AusKeep shall not be liable for any loss, injury, damage, or claim arising from your use of the platform, including but not limited to errors, omissions, service interruptions, or user conduct.

11. Dispute Resolution

AusKeep is not a party to any agreement formed between users and is not responsible for resolving disputes between them. Users are encouraged to resolve any disagreements directly and respectfully. In exceptional cases, AusKeep may, at its sole discretion, facilitate informal mediation. AusKeep does not offer refunds unless legally required under Australian Consumer Law.

12. Indemnity

You agree to indemnify, defend, and hold harmless AusKeep, its affiliates, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or related to:

Your use of the platform;
Any breach of these Terms;
Any services you provide or receive through the platform;
Your violation of any laws or third-party rights.

13. User-Generated Content and Intellectual Property

All content you submit to AusKeep (such as job posts, reviews, or profile information) remains your intellectual property. By submitting content, you grant AusKeep a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the content solely for platform-related purposes. You are responsible for ensuring that your content does not infringe on any third-party rights.

AusKeep ("we", "us", "our") respects your privacy and is committed to handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. What Information We Collect We collect the following types of personal information:

Full name, phone number, email address;
ABN and service category (for workers);
Job post content, reviews, and user activity;
Payment and transaction details (handled by third-party providers);
Device, location, IP address, and usage data (analytics and security purposes).

We collect only the data necessary to provide and improve our platform.

2. Why We Collect It We use your data to:

Create and manage your account;
Facilitate secure job connections and transactions;
Share phone numbers and email only when both parties agree;
Maintain transparency via user reviews;
Monitor, detect and prevent fraud or abuse;
Comply with Australian laws and cooperate with law enforcement if required.

3. Disclosure of Information We may disclose your data to:

Other users (with your explicit consent, e.g., phone number exchange);
Third-party services (e.g., Stripe, analytics, cloud hosting);
Government agencies or regulators if legally required;
Investigative authorities in case of verified reports or suspected illegal activity. We do not sell or rent your data.

4. Storage and Security We use secure Australian or international cloud providers with data encryption and access control.
We take reasonable steps to protect your data, but no digital system is completely secure

5. Access and Correction You have the right to:

Access your personal information;
Request corrections if the data is inaccurate or outdated.

6. Cookies and Tracking We use cookies and third-party analytics tools (e.g. Google Analytics) to:

Improve platform performance;
Understand user behavior and site usage. You can disable cookies via your browser settings, though this may affect functionality.

7. Overseas Disclosure Your personal data may be stored or processed by providers located outside Australia. We ensure any overseas transfers comply with APPs and implement necessary security measures.

8. No Labour Hire Activity AusKeep does not operate as a labour hire provider, employer, or recruiter. We simply introduce parties, and all users are responsible for their own privacy compliance outside our platform (e.g. handling of phone numbers).

9. Changes to This Policy We may update this policy at any time. Changes will take effect once published on our site.

10. Complaints and Contact If you believe we have breached the Privacy Act or your privacy rights:

We aim to respond within 30 days.

You may also contact the Office of the Australian Information Commissioner (OAIC) if you're not satisfied with our response.

At AusKeep, we are committed to maintaining a respectful, safe, and reliable space for both workers and job providers.

This Code of Conduct sets out the minimum standards expected of all users of the platform.

By using AusKeep, you agree to the following conduct rules:

1. Respectful and Professional Behaviour All users must:

Treat each other with respect, regardless of background, role, or rating;
Refrain from harassment, hate speech, threats, or abuse;
Respect time, commitments, and agreed arrangements;
Maintain a professional tone in all communication.

2. Honesty and Integrity Users must:

Provide accurate information about services, availability, and identity;
Not impersonate others or misrepresent qualifications or experiences;
Post and respond to jobs in good faith;
Leave honest and unbiased reviews based on real experiences.

3. Proper Use of Contact Information

Phone numbers and email are shared only after mutual consent;
Contact details must be used exclusively for job-related purposes;
Unsolicited messages, spam, or harassment through phone contact will result in immediate suspension or termination.

4. No Off-Platform Deals To maintain transparency and platform security:

All jobs and payments must go through AusKeep;
Bypassing the platform to avoid commission fees is prohibited;
Users caught arranging off-platform deals may have their account permanently banned.

5. Independence and Responsibility All workers on AusKeep:

Are considered independent contractors;
Must hold a valid ABN;
Are fully responsible for their tax, insurance, and legal obligations;
Must comply with Australian laws and workplace safety standards.

AusKeep:

Is not a labour hire provider or employer;
Does not manage or direct how work is performed;
Does not guarantee job outcomes or user behaviour.

6. Reporting Violations You may report violations of this Code via Email at assistance@auskeep.com. We investigate all serious reports.

Users found to have breached this Code may face:

Warnings;
Temporary suspension;
Permanent account removal;
Legal reporting in serious cases.

7. Legal Compliance All users must:

Act in accordance with Australian federal and state laws;
Not post or accept work that is unsafe, illegal, discriminatory, or exploitative;
Follow relevant local rules on employment, safety, and privacy.

8. Community Expectations By joining AusKeep, you commit to:

Helping build a reliable and honest job community;
Respecting others and taking accountability for your actions;
Supporting a safe and lawful working environment.

Final Note AusKeep reserves the right to update this Code of Conduct at any time. It is your responsibility to stay informed of updates by reviewing this page regularly.
